It is important for you to know that the processing of the purchase of any of the courses available on the https://theindustrial-academy.com website implies the express acceptance by the client of each and every one of the general and specific conditions that are considered an integral part of the reservation and are completed with the specific applicable legislation. For this reason, from the THE INDUSTRIAL ACADEMY team  we recommend the complete and exhaustive reading of the following purchase conditions:

• Reading and understanding the conditions contained in the legal texts of the website.
• Have the legal capacity and capacity to act necessary to carry out the contract.
• Provide truthful and ownership data when required.
• Verification that the data included is correct.
• Responsible management of passwords and cards entered on the website.

In addition to respecting the general conditions set out in the legal notice as a category of user that you hold, you as a customer will be obliged to comply with the following

1. OBJECT OF THE CONTRACT  

From THE INDUSTRIAL ACADEMY we remind you that the rules contained in this document imply a contract between The Industrial Academy Courses, S.L.U. and the user. The purpose of this contract will be precisely the electronic contracting of the courses offered through the https://theindustrial-academy.com website  

The courses offered by THE INDUSTRIAL ACADEMY belong to the sphere of private education, and, therefore, the degree or diploma lacks official effectiveness.

• COURSE OFFERINGS

In compliance with current regulations and, in particular, Law 34/2002 on information society services and electronic commerce and Royal Legislative Decree 1/2007, of 16 November, approving the revised text of the General Law for the Defence of Consumers and Users and other complementary laws,  You can consult the offer of our courses, as well as the fees of the same in the section provided for it.

On our website, in the “Courses” tab you can check the conditions and particular characteristics of each of our offers. In addition, you will have the rest of the information available on our website.

The user undertakes to read the specifications of each of the courses, accepting with the purchase the particular conditions contained in them.

However, THE INDUSTRIAL ACADEMY reserves the right to withdraw, replace or change the offers offered to its customers through its website, by simply changing their content. In this way, the courses offered at any time by the  THE INDUSTRIAL ACADEMY website will be governed by the General Conditions in force in each case. Likewise, the company will have the right to stop offering, without prior notice and at any time, access to the aforementioned products and/or services.

The aforementioned modifications will not affect customers who have already purchased/booked the courses, unless they are the result of a flagrant error or force majeure that prevents the execution of the reservations.

If for any reason, THE INDUSTRIAL ACADEMY is unable to provide the client with the course they have booked, it reserves the right to provide a service under the same conditions. In the event that no agreement is reached between THE INDUSTRIAL ACADEMY and the client, both contractual parties are authorized to cancel the contract and, therefore, THE INDUSTRIAL ACADEMY will refund the amount paid by the client in full.

Published courses that are not available at that time to make your purchase may appear on the website, in which case it will appear in the description “coming soon”. In this case, the “course alert” will be activated. When the purchase of the course can be carried out, the word “coming soon” will disappear from its description and the purchase option will be enabled.

•  REGISTRATION AND ENROLMENT

Registrations to enroll in the courses offered within the THE INDUSTRIAL ACADEMY platform will be made online. Throughout the enrolment and enrolment process, the user of the THE INDUSTRIAL ACADEMY platform  will have the total price of the course in which they are enrolling visibly. 

• PAYMENT TERMS

4.1 PRICES

The prices applicable to each of the courses are published on our website. Before and during the enrolment process, the full price of the corresponding selected course will appear, based on the user’s criteria and needs.

The amount corresponding to the enrolment fee will vary depending on the course and the way in which the user wishes to take it. Well, it has several modes, self-guided, unemployed mode, mentoring mode and scholarship student.

The indicated price includes VAT and other taxes, as well as any expenses that may arise from the purchase.

THE INDUSTRIAL ACADEMY reserves the right to change its fees or charges for courses offered on the Site (or to begin charging for any free services). These modifications will not be applied to purchases already made of courses, maintaining the agreed price for the CLIENT.

4.2. METHOD OF PAYMENT

THE INDUSTRIAL ACADEMY collects its fees for classes and courses through payment gateway or PayPal. We do not have access to the account or card data entered, it is the payment platform that manages it. Please refer to their usage policy for more information. The user acknowledges that he or she is the owner of the means of payment entered. Users are responsible for entering payment data. Likewise, the user is responsible for securely managing the passwords and data entered.

The choice of this platform has been in compliance with European regulations and the required cybersecurity standards.

THE INDUSTRIAL ACADEMY is not responsible for the introduction of cards or other means of payment introduced that do not have the authorisation of the owner of the same, however, it will inform the authorities of the illegal or defective use of cards, when it becomes aware of them.

4.3. PAYMENT VIA BADGE AND POINTS SYSTEM

THE INDUSTRIAL ACADEMY has a system of badges and points for members who are registered within the platform.

By acquiring training badges, users define their teacher-teaching status within the platform. While, by acquiring industry-level badges, users not only define their level within the platform based on their activity and contribution, but can also access certain courses for free.

Free access to the courses will be determined and established in accordance with the provisions of THE INDUSTRIAL ACADEMY, and the user will not be able to determine at any time which course is associated with this system.

4.4. PAYMENT TERM

THE INDUSTRIAL ACADEMY offers the user extensive payment facilities, which can be made through a single payment or by payment in instalments over three (3), six (6) months.

•  MINOR

The courses offered by THE INDUSTRIAL ACADEMY, by their nature, are aimed at an adult audience. If you are making the purchase on behalf of a minor, you represent and warrant that you are legally authorized to act on the minor’s behalf. Minors who are beneficiaries of the courses will have to acquire it on behalf of their parents.

6. RIGHT OF WITHDRAWAL.

In compliance with the provisions of Article 102 of Law 3/2014, of 27 March, which modifies the revised text of the General Law for the Defence of Consumers and Users, the client has 14 days to return the course.

If the execution of the course, with the informed consent of the user, begins before the 14 days have elapsed, based on the provisions of art. 103.m) TRGDCU, the user will lose the right of withdrawal.  This means that you, once the course has started, will NOT have the right to withdraw from it.  

By accepting these terms and conditions of purchase, you acknowledge that you agree, if necessary, to start the course within 14 days of exercising your right of withdrawal. Likewise, it acknowledges that it is aware of the consequences of such acceptance, that is, the loss of withdrawing from the contract entered into with THE INDUSTRIAL ACADEMY.

In compliance with current regulations, in order for your waiver of withdrawal to be lawful, you will be notified via the email indicated by you of the start of the course within the period of the right of withdrawal. If you do not respond to this notification, we understand that you give your consent at the beginning of the course, being aware that it will mean the loss of the right to withdrawal.

• CANCELLATION AND REFUND   POLICY.

THE INDUSTRIAL ACADEMY will not be responsible for the reimbursement of the courses unless it is the refund period for virtual classes mentioned in the previous section.

Students will receive a full refund if the course is cancelled after the registration period, but before the start of the course.

Courses purchased under the scholarship program are NON-refundable.

THE INDUSTRIAL ACADEMY. will not issue the training completion certificate until you have completed all course payments, in any of the installment plans detailed above.

•  COURSE CONTENT

8.1 INTELLECTUAL PROPERTY AND INDUSTRIAL PROPERTY

THE INDUSTRIAL ACADEMY. reserves all intellectual and industrial property rights contained in the course. Not ceding or allowing any other use to the user than the merely individual and non-commercial one. The copying, total or partial replication of the content included in the courses will be prosecuted.

The trademarks, logo, patterns, methodology, syllabus, recordings and other contents of THE INDUSTRIAL ACADEMY. (Materials) included in the courses or on the website, are protected by intellectual property rights. Access to the course does not grant you the rights to these materials.

You may not use the content of our site unless permission is sought and granted. It is also forbidden to use the trademarks and logos included in the courses or website, without our consent; in addition to removing, obscuring or altering the text or notices included in the THE INDUSTRIAL ACADEMY. Materials  , since it is prohibited to use them to assemble any database.

Both the methodology of the courses offered and the syllabus, recordings, materials disseminated in them, previous or subsequent teaching materials, as well as any other type of content that is distributed therein, are protected by copyright and are the sole owner of the same. 

The acquisition of the training courses does not imply any transfer of exploitation rights over the intellectual property contained therein. And in case of infringement it will be prosecuted

The student undertakes, in addition to respecting other conditions, to take classes only for educational reasons and never with the intention of copying materials or techniques for their own benefit, whether economic or professional (including teaching).

In more comprehensive legal terms, THE INDUSTRIAL ACADEMY. grants you (as a student) a limited, non-exclusive, non-transferable license  to access and view the classes and associated content for which you have paid all required fees, solely for personal, non-commercial, and educational purposes through the platform, in accordance with these Terms and with the conditions or restrictions associated with each particular course.

All other uses are expressly prohibited. Specifically, you may not reproduce, redistribute, transmit, assign, sell, retransmit, rent, share, loan, modify, adapt, edit or create derivative works from, sublease, transfer or use any kind, unless we give you explicit permission to do so in a written agreement signed by an authorized representative of THE INDUSTRIAL ACADEMY.. Likewise, you will not be able to grant your credentials to someone other than yourself.

8.2. ACCESS BY THE USER.

THE INDUSTRIAL ACADEMY may suspend the user’s access to all or some parts of the Site, at any time and without reason, immediately due to technical failures that are beyond the knowledge of THE INDUSTRIAL ACADEMY, and cannot be held responsible for them.

• APPLICABLE LAW AND JURISDICTION

THE INDUSTRIAL ACADEMY is based in Spain, so it is bound by Spanish and European laws on Data Protection.

The User accepts that any claims or complaints against THE INDUSTRIAL ACADEMY arising from or related to the use of this website and more specifically to the processing of their personal data will be resolved by the court of competent jurisdiction located in Seville. In the event that the claimant holds the status of consumer or user in accordance with the General Law for the Defence of Consumers and Users, the person located in the place of the consumer’s or user’s domicile  will be competent.

If the User accesses this site from a location outside of Spain, he/she is responsible for complying with all local and international laws that apply to him/her.

1. MODIFICATIONS

THE INDUSTRIAL ACADEMY reserves the right to make any modifications it deems appropriate, without prior notice, to the General Conditions.
